In traditional Chinese society,feudal official rites tied women and emphasized female family obligations while ignoring female family rights,making them male accessories.In the early years of the Republic of China,China's traditional legal system gradually transformed itself into a modern one,which objectively provided a powerful impetus to the change of traditional female family rights.Dali Yuan,as the highest judicial institution that has the highest judicial power and the power to interpret laws,has given women certain family rights through the form of judgment in judicial practice.This change took place in the context of the advent of advanced ideas from the West in modern times,the advocacy of advanced intellectuals and the awakening of the female groups themselves.It is mainly reflected in the fact that women have obtained certain personal rights,property rights and inheritance rights in family life.However,due to the long-term influence of the feudal ideology,the big flaws in legislation and the existence of some problems in the female population itself,the changes of female family rights in the early Republic of China reflected the characteristics of both progressive and incompleteness.Up to now,the issue of family rights of women is still a hot topic of social concern.The improvement and guarantee of their family rights are still the problems to be solved.In order to solve this problem,we must first eliminate the long-existing feudal ideology and change the people's ideological inertia.Secondly,it is necessary to strengthen the legal system and provide legislative and judicial guarantees to solve the problem of female family rights.Finally,we must also promote female from their own groups Emancipate the mind and cultivate an independent consciousness.
