| Central judicial office in early Republic of China(1912-1927)was established in the modernization transformation era of China legal system.As national supreme judiciary authority,the prejudication system of central judicial office solved the problems such as legislation deficiency and insufficient reference for judicial judgment;on the other hand,it integrated Chinese and western cultures to explore a legal system transformation path suitable for national conditions at that time.For this reason,prejudication system plays vital role in the development of legal system during Republic of China,as well as the modernization transformation of Chinese legal system.The civil prejudication system of central judicial office formulated during the operation effectively guided the judges of courts at all levels,solved the problems of parliament suspension and severe deficiency of legal basis in trials,and enabled judicial judgment to adapt to the ever-changing new phenomenon.Meanwhile,it enhanced lawsuit efficiency,optimized application of trials,settled the issues of scarcity and poor attainment of talents in courts at all levels,made judicial acts proceed in order and provided important guarantee for the social life in transformation era.In addition,only a few scholars researched how civil prejudication system completed tasks in the rule of turbulent Beiyang Governmental,its characteristics and significance,which also is the key point of this paper.By means of studying relevant literatures and documents,this paper researched the civil prejudication system of central judicial office in early Republic of China,which showed the characteristic of civil prejudication system in early Republic of China for realizing its function.Moreover,it explored the positive influence of civil prejudication system of central judicial office in early Republic of China on contemporary society,so as to look for its enlightenment to Chinese existing case guiding system. |
