On The Construction Of Special Criminal Procedure For Terrorist Activities In China

At present,China's counter-terrorism situation is very serious.Terrorist forces such as “Tibetan independence” and “Xinjiang independence” have launched a number of terrorist attacks while creating an atmosphere of terror,seriously threatening the country's security and causing massive damage to people's lives and property.On the one hand,the special needs of escalating terrorist crimes in investigations,prosecutions,and trials urgently require relevant procedural legislation to respond.On the other hand,from a global perspective,due to different counter-terrorism situations and legislative traditions,many countries' special criminal procedure legislation on terrorist activities crimes is ahead of our country.Therefore,under the background of the continuous improvement of the "Criminal Procedure Law of the People's Republic of China",we can draw lessons from the legislative cases of criminal special procedures for terrorist crimes in relevant countries with rich experience,and follow the reform of the 2012 Criminal Procedure Law,in the Criminal Procedure Law.In the investigation,prosecution,and trial of terrorism crimes,special provisions have been made for the links between the ordinary criminal procedure and the criminal special procedure provisions in the Criminal Procedure Law to form a legal basis for effective counter-terrorism.
