On The Legality Of Complete Surrogacy And Its Legal Regulations

The generation and development of the surrogate phenomenon has been for a long time at home and abroad,with a surrogate chaos has not been thoroughly solved,resulting in a number of relevant practical problems and legal problems.And this problem has been puzzling scholars at home and abroad;After further research on the surrogacy issue,some countries have found a more reasonable way to effectively regulate surrogacy,while some countries are still helpless,or their regulations are unreasonable and inappropriate.There are still a lot of subterranean surrogate activities in our country,and the regulations of the state have not received good results.The chaos of surrogacy has intensified in our country,and it is necessary to think about and seek for change in the current rules.Starting with the background of the problem of surrogate,this paper summarizes and analyzes the existing problems of surrogate,analyzes the essential attribute of surrogate from the angle of law,so as to make it clear that it is different from the bad habits such as "having children with belly".At the same time,it analyzes the particularity,legality and feasibility of the method of complete surrogacy,and studies the different methods of regulating surrogacy in foreign countries,and reviews the disadvantages of the regulation practice of surrogacy in China.Finally,it seeks new enlightenment in the comparative study,so as to promote the legal and effective practice of regulating surrogacy in China,so as to promote the correct understanding of surrogacy,and to guide the special group to use the artificial auxiliary reproductive technology with reasonable and limited use of the surrogate.This paper body content mainly consists of four parts: the first part focuses on the essential characteristics of surrogate and complete surrogate,and analyzes the essential elements of the complete surrogacy.The purpose is to define what is the modern conception of surrogate from the angle of law and the superiority of the formula of the complete surrogate.In the second part is carries on understanding of surrogate had different from traditional ideas,the author discusses the legitimacy of full surrogacy from three aspects: ethics,jurisprudence and realistic value,andexpounds the practical feasibility of full surrogacy.The third part mainly discusses the different approach to study outside regulation surrogacy,and reviewed the analysis of the disadvantages of our country related regulation rules,then obtaining the correct enlightenment from the practice of outside.The fourth part is the preliminary conception of our future surrogacy regulation rules,which is an inevitable step to solve the problem after analyzing the surrogacy problem.
