Research On The Legal Problems Of Surrogacy

With the accelerating pace of contemporary life and increasingly severe environmental pollution,the survival pressure of life of modern people is gradually increased,and the proportion of the risk of infertility is increasing year by year.According to the national authoritative department statistics,Chinese about 40 million of infertility patients,and the increase in the number of digital to about one hundred thousand people each year,in the 230 million couples of child-bearing age,suffering from infertility accounted for 15%to 20%.With the desire and needs of many infertile couples for fertility,a variety of artificial assisted reproductive technologies have emerged.In addition to the well-known artificial insemination technology and in vitro fertilization technology,the combination of the above two technologies and the generation of a large number of techniques have been applied to the actual infertility.Surrogacy refers to the wife because of various reasons can not be pregnant,and borrow other women's uterine pregnancy for their own children.With IVF and other assisted reproductive technologies,surrogacy brings a series of problems to the society of family ethics and law,surrogacy is legal,the legal consequences of their behavior should be how to regulate,how to evaluate its impact on society,China has no unified standard and cognition.In the absence of unified standard and evaluation of surrogate behavior at the same time,due to huge demand,in our country,commercial surrogacy situation has become more and more serious,the emergence of a large number of surrogacy agency,the surrogate and related behavior formed a chain of interest,in the absence of regulation under the condition of the underground surrogate market formed in the gray areas of surrogacy industry.Surrogacy is often accompanied by a series of problems,such as compensation for rights disputes in our country,the legislation is still blank situation,how to regulate surrogacy,protect the legitimate interests,combating illegal purposes by the surrogate implementation behavior,is a major problem placed in front of law.This paper will study the other surrogate assisted reproductive technology,research the legal problems of the legal regulation of surrogacy,similarities and differences between the comparison of various countries,through the analysis of actual cases of China's existing laws and regulations on efforts to regulate surrogacy,and combined with the status quo of China's future feasibility to regulate surrogacy mode.Effect of legal issues from the legal perspective analysis of surrogacy behavior and its consequences and causes to the society,the assisted reproductive technology in the law under the premise of controllable better service for people.
