E-commerce provides a new environment and new opportunities for China's economic development,and Third-Party Payment is a new type of industry born in this case.Under the protection of network security technology,Third-Party Payment uses a novel payment mode to continuously increase the transaction share.But at the same time,the problem is constantly emerging when Third-Party Payment industry continues to develop.At present,Third-Party Payment industry in China is characterized by a high degree of market concentration and clear control of market by oligopoly,which means a kind of product is basically provided by only a few companies.How to apply our country's laws and regulations to supervise the phenomenon of Third-Party Payment monopoly,then this article will analyze in detail the issues of Third-Party Payment monopoly,the focus of the dispute,the monopoly approach,the nature of monopoly,and the formation of reasons,based on the “Anti-Monopoly Law” and related theories to research and put forward specific proposals on the legal regulation of Third-Party Payment monopoly issues.Firstly,it elaborates on the concepts and characteristics of Third-Party Payment,and introduces the history of development of Third-Party Payment and analyzes its development status.Through phenomenal description,it reflects the influence of Third-Party Payment on the market,and points out the monopoly of Third-Party Payment industry.Secondly,it compares and elaborates on the controversial focus of Third-Party Payment monopolies in the current theoretical community.Based on this,it conducts a legal analysis of Third-Party Payment companies' abuse of market dominance;by analyzing the essence of phenomena,it points out the ways in which third-party payments are conducted and the phenomena of predatory pricing and tie-in in several payment platforms;after defining the nature of monopolistic behaviors of Third-Party Payment companies,it is clear that the nature of Third-Party Payment monopoly is commercial monopoly,and the behavior of Third-Party Payment monopoly and its Cause of formation are all analyzed..Finally,the situation of supervision of Third-Party Payment industries in China's relevant laws and regulations was introduced.Based on the situation of legislation,the anti-monopoly regulation system for Third-Party Payment companies' abuse of market dominance was put forward;it was considered that they could be related to the Anti-Monopoly Law.And through the understanding of monopolistic cognizance standards and the use of reasonable principles of antitrust law to solve our country's Third-Party Payment antitrust issues.
