Criminal Law Regulation Of Network Rumor Crime In China

With the development of society,the crime of network rumors is increasing,which has brought serious interference to the system of social trust as well as daily life and production for the people.In recent years,China has accelerated the legislative process of the crime of network rumors,we have been starting to established the norm of criminal law and issued the judicial interpretation,in order to include it in the existing accusation or new accusation.From the reality harmfulness of network rumors,the writer has discussed the concept and characteristics of the crime of network rumors in detail,and has summarized the features about the crime of network rumors through the comparison with other similar concepts.Then,through the analysis of our country's current situation about criminal legislation in network rumors,the author has summarized the deficiencies in our criminal legislation system and the judicial system.It is mainly reflected in the imperfection of the accusation system;The boundary between private prosecution and public prosecution is not clear;The allocation of penalty is not perfect;The standard of incriminating is uncertain and so on.Finally,the author has put forward some feasible suggestions for how to complete our Criminal Law Regulation in the crime of network rumors,which are from the criminal legislation and criminal justice perspective.
