On The Criminal Law Regulation Of "Ryan Fire" Network Rumors

Nowadays,the number of Chinese netizens has reached six hundred and forty-nine billion, and mobile phone users has broken five hundred and fifty-seven billion. Although the network society is a fictitious society, it closely relates or even makes great influences on our real society. During the past twenty years, internet promotes the social political democracy, economic development, cultural prosperity and the open society. It cannot be neglected that the internet rumors are more and more populous, which libels other persons, destroys governmental images and seriously influences the social development and stability.In September 2013, new judicial Interpretation on net libel was smoothly promulgated and Office of the Central Leading Group for Cyberspace Affairs was founded On February 27, 2014. The party’s fourth plenary of eighteen session put forward the general aim and the major task on ruling the country by law. Therefore, we must severely punish the net rumor-makers.On April 17, 2004 the Qin Huohuo net rumor case has attracted lots of people’s attentions, which is the first the case after the new judicial Interpretation on net libel.Firstly, this paper reviews the Qin Huohuo net rumor case, finds out six main arguments concerning this case. And then it illustrates the concept,causes and dangers of net rumors in the view of the Qin Huohuo net rumor case. This case involves two main crimes which is net libel crime and rumors stir-up trouble crime. The paper mainly analyses the constitution of the two crimes and the six arguments. Finally, it focuses on the analysis of the criminal difficulties on the criminal punishment of net rumor-makes and puts forward four suggestions on this provision. The author hopes it paper can do good to the management of internet society, and governance the rumors, which helps create good cyber space.
