Research On Housing Investigation On The Running Condition Of Case Registration System In Danzhou People's Court Of Hainan

The problem of "difficulty in filing a case" has always been an important cause for the society to criticize the judiciary.The Fourth Plenary Session of the 18 Central Committee of CPC puts forward that "changing the c case-filing censoring system into the case-filing register system".This system has effectively alleviated the present situation of "difficulty in filing a case" since it was put forward more than a year ago,which is a great progress in the legal construction.However,there are also many problems.The reform of the case-filing register system is of great significance to fully protect the litigant's rights,resolve the problem of "difficulty in filing a case" as reflected by the people from the system,promote the building of a fair,efficient,and authoritative socialist judicial system and the socialist legal system with Chinese characteristics,and promote the construction of the rule of law and the protection of human rights in China.From the investigation of the registration of the Danzhou people's Court on filing a case,the main problems are:the number of cases increase sharply,and the pressure on judges increases,which affects the efficiency of litigation;there is the misunderstanding of "cases must be filed,and cases must be justified";the division of functions is not clear;the abuse of the prosecution right has increased significantly;the situation of complaint letters and visits are not optimistic.The cause of these problems,the main reason is:the weakening of case "filter"function and pre litigation dispute settlement mechanism is not perfect;the media propaganda to mislead the parties;the registration system is not perfect;legal awareness and legal knowledge but lacks the ability of litigation over expectation;the parties registered with the judicial judgment of the case.In order to solve the above problems,the following measures can be taken:Case diversion,scientific ratio;the guarantee of working mechanism;accurately grasping the relationship between "accepting all indictments" and "not to file a case";consummating the related laws,and distinguishing the prosecution elements and the lawsuit essential documents;strengthening and perfecting the relevant measures to indiscriminate lawsuits;perfecting the system of letters and visits.
