Sports programs has become an important part of the economic development of sports industry.The ratings of sports programs directly affect economic interests.The phenomenon of unauthorized network platform play the programs is serious,which directly prejudices radio and television stations' broadcasting rights.Injudicial practice there is a great dispute on the recognition of copyright and neighboring rights of sports program events programs.The difference mainly lies in the identification of"originality" and the choice of the way of protection.I believe that it is important to realize that the digital technology background of the Internet has changed a lot with the traditional sports events of yesterday.So we need to fully understand the playback mode,technology model and profit model of sports events programs.I think that the copyright of sports events should be considered respectively.I don't think the sports competition program can achieve the originality requirement of the work,but it does not exclude the individual outstanding and unique sports events program composition.In the judicial practice,the protection way of sports events is related to the concept of copyright protection.I insist on copyright law as the best choice of sports event protection.It is mainly divided into two kinds of protection paths.One is to distinguish the sports events and video products from the originality,the other is to control by the relay signal.Perfecting the right of broadcasting organization and bringing the Internet into the category of broadcasting rights to control the tort.At the same time we should use anti-unfair competition law with caution,and guard against the general escape of sports events from copyright law protection to general anti-unfair competition law.
