Research On Copyright Protection Of Sports Programs

Although the rapid development of sports industry has greatly promoted the cultural industry,there are also many challenges with the rapid development just like increasingly serious infringement cases of sports events.However,the existing copyright law in China has no rules to protect the program of sports event So we must pay attention to the protection of sports events.In this paper,we will discuss the quality and legal protection of sports programmes.We hope that we can render own contributions to the protection of sports programs in the judicial practice and theoretical research for our country.In addition to the introduction and conclusion,this paper is divided into five parts.The main contents are as follows:Firstly,the definition of sports events should be analyzed in a deep way.Put forward the viewpoint that agrees with "works theory" In addition,in judicial practice,the judge should judge the "originality" problem,and also refer to other related factors,such as the purpose of creation and the capital invested.The third part summarizes the existing protection situation of China’s sports events.This paper summarizes the current protection of sports events in our country as follows:First protection,defines the nature of the sports show as "video recordings said," The second view is that the nature of sports events should be "works" and should be protected by copyright.The third kind of view is the anti-unfair competition law to protect,nusing the anti-unfair competition law to effectively regulate the infringement of sports programs.The fourth part aims at how to effectively regulate and protect the sports competition programs in China,and put forward legislative proposalsIn short,China’s current laws for the tort of sports programs protection is far from enough,our country should solve this problem as soon as possible,strict blow "stolen by" behavior,for the development of sports industry in China to create a stable and healthy environment.This paper tries to make Suggestions on the quality and the standard of "originality" of sports events,and contribute to the improvement of copyright law.
