Research On Judicial Appraisal Management Of Primary People's Court In Shandong Province

As an important part of judicial activities,judicial appraisal is the forensic activity that judicial authentication institutions legally accept the entrustment,and qualified appraisers provide expert opinion with science and technology or expert knowledge involving special issues in the contentious procedure.Judicial appraisal is the most important methods and means to identify the facts.Judicial appraisal opinion,as one of legal evidence,plays an increasingly important role in the proceedings in the current society.Meanwhile,with the development of the construction of democracy and the rule of law in China,the status and role of judicial appraisal in serving litigation activities is becoming increasingly prominent,it is of great significance for maintaining and promoting judicial justice in our country.The scientific activities of judicial identification can effectively guarantee the people's legitimate rights and interests,ensure the fundamental interests of the parties.Judicial appraisal has the judge no longer just be judged on the basis of regular judgment,providing strong evidence for the judge,and fully guaranteeing the appeals of the parties in a reasonable and legitimate way.With the continuous improvement of the rule of law in China,the level of judicial appraisal management is also improving,and the behavior of multiparty identification and repeated identification is also decreasing.The reliability of judicial appraisal in the commission of court is increasing.However,we have to admit that there are still a lot of problems in the judicial appraisal of the current primary courts.This paper will combine the actual situation of the judicial appraisal management of the primary court of Shandong Province,analyze the existing problems,and then put forward the corresponding promotion strategy.There are some problems such as relative inequities,low efficiency of litigation,non-unified charging standards,insufficient appraiser and low diathesis,low management quality,which seriously affected the function of judicial appraisal.The public questioned the problems exposed in the field of judicial appraisal.Therefore,the establishment and improvement of the judicial appraisal system which is suitable for the development of economic and social development,the construction of democratic legal system and the progress of science and technology should be established.The primary people's court needs to improve the level of the management of judicial appraisal.Therefore,primary courts should fully learn from the experience of the management of judicial appraisal abroad,perfect the judicial appraisal procedure,reasonably determine time of judicial appraisal,unify the management standards of judicial appraisal to improve the information disclosure mechanism,strengthen the judicial personnel allocation,strengthening communication and cooperation and other aspects of the work,and striving to improve the efficiency and quality of management of judicial appraisal.Judicial appraisal is an organic link of judicial activities,which is directly related to the realization of judicial fairness and justice and the protection of the legitimate rights and interests of the parties.To establish and perfect the political institutions and the management system which reflecting the judicial appraisal's law of development accord with Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era,give full play to the role of the judicial appraisal,and timely and properly handle social contradictions and disputes,have important positive roles in maintaining social fairness and justice according to the basic strategy of rule of law.Primary courts must attach great importance to the cases of judicial appraisal and improve the quality of judicial appraisal's cases.Based on the above goals and ideas,this paper uses the methods of literature study,field investigation,historical study and comparative study,starting from defining the relevant concepts,to research on judicial appraisal management of Primary People's Court in Shandong province.Finally,the paper will find out the problem and put forward specific countermeasures.
