As the most important political thinker of the 20 th century,Hannah Arendt proposed a new thinking about human rights from his unique perspective.In the view of Arendt,Human rights is a political concept,and when people separate from the political community,they only have the rights of pure animals.That is,they have no rights at all.Therefore,on the basis of criticizing traditional human rights views,Arendt put forward the “right to own rights”——the right to belong to a political community.Arendt thinks that this is the most basic right.Once this right is deprived,all the rights granted by the state will become impossible.Arendt believes Human rights is not a gift of nature but an e xclusive civilized person.This article is to explore Arendt's human rights thoughts from its experience of statelessness.It aims to clarify Arendt's understanding of the crisis of traditional human rights,how to solve this crisis,and what she thinks about her experience of human rights.The first part mainly analyzes Arendt's criticism of traditional human rights theory.Arendt thinks why the traditional human rights ideology loses its realistic validity,an important reason lies in the basic flaws that make it impossible to securely link between formal rationality and substantive relief.The 18 th century human rights designers gave individuals dignity and rights in an abstract and universal manner,it makes the right unreal.What's more,the "Human Rights Declaration" constructed according to this logic is destined to fall into the huge gap between man and citizen and is not operability.According to Arendt,the disaster that has erupted in the human rights field undoubtedly proves the limitations and shortcomings of traditional human rights theory.The second part examines the reasons for the occurrence of the traditional human rights crisis.Arendt's reflection on human rights is not an abstract speculation,but is based on reflections on the entire modern society.She analyzes the dangers caused by the reverse victory of modern labor animals,and the threat posed to humanity by totalitarianism.All these factors have undermined human dignity and made it impossible for human rights to be maintained.Arendt clearly realizes that if we want to resist the destruction of people caused by modern society,we need to re-examine the conditions of human rights.The third part mainly explains Arendt's way out of the human rights crisis.Based on her understanding of the human rights crisis,Arendt put forward a new understanding of human rights,namely "the right to have rights".The enjoyment of rights is related to the acquisition of citizenship,and "the Right to have rights" means that people have an identity t hat can enter the community,that is,have a place in the world.when people have citizenship and together with others,they act actively in a common world,gain dignity and humanity through public spaces.Only this can rule out the human rights dilemma and resist the "Desert Storm."The fourth part primarily rethinks Arendt's human rights thought from the perspective of phenomenology.Arendt's way of thinking about human rights is phenomenological.Inspired by the phenomena of phenomenology,Arendt belie ves that we must understand what has actually appeared to us and the world we live in,in order to reveal people's existence and dignity.In Arendt's thinking,the root of human existence lies in working with others to create a public space in which people can publicly express their voices and opinions to show their uniqueness.Therefore,Arendt's goal has already pointed to traditional political philosophy itself.Politics is a field of opinions,not the silent world of “universalism”.Arendt emphasizes the restoration of political autonomy and advocates the reflection of philosophy to return to the rationale based on the actual survival of human beings.As one of the pluralistic voices of society,although Arendt did not form a systematic human rights theory,her unique way of thinking about human rights offers new possibilities for us to re-examine Human rights.Therefore,it is extremely important to discuss Arendt's human rights ideology and rethink it.
