With the development of modern industry,energy is consumed,and thus produce large amounts of greenhouse gases,the global temperature increased gradually,the north and south polar and Plateau glaciers rising sea levels,various countries and regions of extreme weather occurred frequently,causing a great threat to the survival of human beings,the climate problem has gradually become one of the most concerned issues for the international community.In order to cope with the impact of climate change,the international community to actively take various measures to control greenhouse gas emissions,the 1992 United Nations Conference on environment and development by the 155 member countries signed the "United Nations Framework Convention on climate change" has become the international common law treaty,many of its provisions in principle is the foundation of legislation for international the social environment treaty,in order to refine the relevant provisions of the "United Nations Framework Convention on climate change" the impact of climate change is more effective,in Kyoto in December 1997 held a "United Nations Framework Convention on climate change" and the third session of the General Assembly passed the "Kyoto Protocol" to slow down global warming.Carbon trading market began to develop quickly in the "Kyoto Protocol",countries have also started construction of the carbon trading legal system,integrate with the international community in the carbon trading system,in which the EU development is rapid,the carbon trading market scale is the largest in the world,but also the legal system more perfect.To complete the task of reducing emissions and reduce economic cost.Compared with the European Union and the United States,China's carbon trading market belongs to the initial stage of construction.Without a unified trading rule and trading market,the construction of the legal system is not perfect enough.Since the reform and opening up,China's rapid economic development,but the contrast is the damage to the environment,beautiful scenery is jinshanyinshan,economic development should not be at the expense of environmental pollution and ecological destruction,China is the largest developing country in the world,should bear the corresponding environmental responsibility,and improve the carbon trading market is one of the most important take the road of sustainable development.The construction of carbon trading market needs the protection of law.The long-term healthy development is inseparable from the construction of corresponding legal system.This article will analyze and draw lessons from the relevant laws of the European Union and the United States,and put forward suggestions for the construction of legal system suitable for China's national conditions.Study on carbon trading market should be two-way exploration from the perspective of economics and law point of view,the development of carbon trading market cannot do without the support of the financial industry,more cannot do without the protection of the legal system,from the aspect of subject,distribution mode and supervision responsibility of each link is legal researchers need to explore and improve the problem in the research in the previous analysis mainly analyzes the legal theory,this paper from the side to increase the economic analysis,the carbon emissions trading is more solid,the law is to protect the legitimate rights and interests of the transaction are not infringed,but also to ensure the good operation of the overall macroeconomic,so this paper combined with Europe and other developed countries experience and according to the actual situation of China's economic development,giving advice to improve the construction of China's carbon trading carbon trading market and the legal system of Deep exploration.
