A Study On The Challenges And Countermeasures Of The Right To Development Of China Since Reform And Opening Up

In short,the right to development is the right which human beings can enjoy sustainable development as a person.After World War II,the old international political and economic order which established on the basis of imperialism and colonialism,made it difficult for developing countries to compete internationally and the right to development came into being under such historical background.However,the right to development has been suffered setbacks and hardships since it been proposed.If it want to against western hegemonism with strong theoretical weapons,and if it's attribute of the basic human rights wants to be recognized in the international community under the strong questioning of the developed capitalist countries,the right to development needs to demonstrate its rationality and legitimacy with a series of theoretical and practical results.As the largest developing country,China has been adhered to combine with the universal principles of human rights and the specific national conditions,has been insisted on the right to subsistence and development as primary basic human rights,explored a development path with Chinese characteristics.China's achievements of reform and opening up practice in the past 40 years have enriched the concept and promoted the practice of the right to development.At present,we study and summary the concept and practice about the right to development of our country since China's reform and opening up,and analyze its international and domestic challenges furtherly,explore the effective way to enhance the influence of the right to development in our country,it is of great significance to no matter to the international community or our country to the implementation and further development of the right to development.In addition to the introduction part,this paper is divided into four parts.The first part mainly defines the concept of the right to development,and summarizes the thoughts of marxism on the right to development.In this part,the paper introduces the background and tortuous process of the right to development firstly,and quoted the definition of the right to development by Prof.Wang,the author analyzes the meaning of the right to development from the perspectives of semantic structure and existence form.And on this basis,this paper summarizes the thoughts of marxist classical writers and the Communist Party of China on the right to development.These are the theoretical basis for this study.The second part summarizes the concept and practical achievements of China's right to development since the reform and opening up.This paper summarizes the basic contents of China's right to development from the perspectives of the status,subject,content,essence and realization of the right to development.In the practice of the right to development,this paper summarizes the China's practical achievements from the economic,political,cultural,social and ecological fields with a large amount of official data and relevant government documents.The third part analyzes the challenge of China's concept and practice of the right to development.The further implementation and development of the right to development of our country,is not only faced the challenges brought by the globalization of human rights,the restriction of the incomplete international law,and the constraints of complex international environment,but also faced the imperfect domestic rule of law,the disadvantages of the socialist market economy system,and the serious anti-corruption work.All these are hindering the realization and guarantee of China's right to development.In the fourth part,the author puts forward some countermeasures for the challenges of the right to development in the upper part,and finds effective path to improve the influence of our country's right to development.It is hoped that the research on the right to development will be enlightened in the future.
