On Constitutionality Of Registration Requirements For Unified Examination Of Legal Profession

Legal professional qualification examination is the assessment system for selecting qualified legal talents for building a country under the rule of law and improving the judicial system in China.The Review of constitutionality,that is,from the perspective of non right organs,we should examine the legislation based on the constitution spirit,principles and constitution,legislative law and other superordinate laws.In legislation,we should consider its constitutionality and provide a constitutional perspective for sectoral legislation.From the change of the reference conditions of the assessment system,the reference conditions for examinees are generally combined with the restrictions and relaxation policies,which conform to the principle of reasonable difference in the right to equality.From the view of constitutionality,by examining the regulations of the Department from three aspects of legislative authority,right content,constitutional principle and spirit,it is concluded that the Department's legislation in the Ministry of justice has anomie and has a clear conflict with the constitution.
