With the continuous development of electronic technology,and the popularization and miniaturization of artificial intelligence machines such as mobile phone and computer.With the help of electronic technology,more and more contracts are reached and the number of transactions is increasing.Relative to the large-scale use of electronic contracts,China's legislation on electronic contracts is relatively lagging behind,which is undoubtedly a hidden danger for China's booming e-commerce.In the long run,a good economic order can not be established in the market economy of electronic contract,which will undoubtedly restrict its economic development.The study of electronic contract has become an urgent problem to be solved.Therefore,this article takes the relevant legal issues of the electronic contract as the breakthrough point and divides into the following parts:First,the characteristics,types,signing methods,participants and objects of the electronic contract are analyzed,and a general introduction is made to the electronic contract.It also describes the issues related to the virtual property in the object,the offer during the signing,and the arrival time of the offer invitation and offer.The second part is about the electronic contract law briefly,mainly divided into two aspects in our country and foreign country,first,the current laws and regulations about electronic contract in China and in the judicial practice for the identification and judgment of the electronic contract are mainly introduced and analyzed for.Secondly,the laws and regulations about electronic contracts between the US and the EU are analyzed,and compared with our laws,it is concluded that our legislation on electronic contracts is not enough.In the third part,for several popular electronic contract and summarizes,mainly divided into the following parts: the legislation of virtual property,distinguishing between advertising in the electronic contract,false propaganda and offer an invitation to offer,the subject of electronic contract uncertainty etc..The above problems are in the actual operation,and have a serious impact on the electronic contract.Finally,based on the above contents,we put forward some important opinions on the construction of electronic contract laws and regulations in China,hoping to be beneficial to the related process of our electronic contract legal system.
