On The Problems And Improvement Of The Public Interest Litigation System Of Environmental Administration In China

Procuratorial organs mention that administrative environmental public interest litigation is a special litigation system which newly established in China.It is a long trail process after two years of pilot and formally stipulated in the "administrative procedural law".Safeguarding national and public interests by instituting public interest litigation has become the new mission of procuratorial organs under the new era.However,when we examine the existing administrative public interest litigation system from the perspective of better maintenance of social welfare,there are still some problems such as imperfect laws,incomplete interpretation and unreasonable supporting system.Therefore,exploring the development path of administrative public interest litigation,perfecting the system of administrative public interest litigation,environmental administrative public interest litigation procedures,and establishing a scientific and reasonable evaluation mechanism become the key link connecting practice and legislation.
