| In recent years,China's telecommunication network fraud crime incidence has increased dramatically,the crime is committed by using communication tools and internet technology.the quantity of crimes has grown by 20% every year,which not only violate the citizens' property safety and other legally rights,but also threaten the manage order of national radio communications and internet safety.this issue bothers the people and government seriously.and it attracts the highly attention to the Party Central Committee and Ministry of Public Security.Every level of National Public security organization did many efforts on the prevention and fight crime.However,the serious crime situation cause lots of difficulties to detection work.How to resolve the problem and govern the telecommunication network fraud crime will need more investigation and research.Therefore,the article shows four sections as below:Firstly,the general of telecommunication network fraud crime.we definite it as controlling victims in a long distance and no physical touch by using phone,internet,internet telephony and massage.And illegally obtain large value of money.But there are arguments about the definition between theory fields and practical fields.Meanwhile,the telecommunication network fraud crime is actual a "Exotic Crime" which becomes the current form after the transition.Nowadays,the typically crimes are manipulation of consume credit,online dating and virtual service.Besides,it is showing a new crime trend under the new era background.Such as the regionalism of the place,accuracy of the information.secondly,the current condition of investigation of telecommunication network fraud crime.although it's a new kind of crime,it is criminal offence essentially.we could base on detective principle of criminal offence to know the network crime and explore the investigation thinking.use special methods and ways according to the character.For example,associated bank account,telephone tracking location and woven cases.Based on the specific situation,time or area.We can use different methods in a flexible way,like choosing project team and project management.And targeted combat the telecommunication network fraud crime.But,to achieve the prevention and fight the crime,the public security organ will need to form a specific work mechanism.To deal with complicated cases,the security organ should alsoworking on cooperative combat,synthetic combat,information sharing and cross-regional cooperation.Thirdly,the dilemma of detection and root causes of telecommunication network fraud crime.the difficulties that Public security organ are facing are various,which can be roughly divided into four aspects:the first one is the detective foundation.this new kind of crime is high-tech,with the limited detective resources,the current organization,equipment and technical talented person are not strong enough to deal with the crime situation.the second one is the detective jurisdiction;the cross region and cross country are causing the jurisdiction dispute between our security department and other region and country.On the other hands,there are jurisdiction conflicts among domestic public security organs.The third one is investigation of evidence.Fourthly,the solution and direction of telecommunication network fraud crime investigation.pointing out the problems in detective work,resolve the dilemma of detective foundation.we could expand the talent poor of network professionals,complete the critical equipment,set up specific origination;for resolving the dilemma of detective jurisdiction,we're able to perfect the relevant laws,enhance then cooperation among different locations;for resolve the dilemma of detective evidence and arrest,we could improve the information sharing among domestic public security organs,and build stable and long-term evidence collective cooperation mechanism,institutionalize the case handling assistance,and strictly manage the passive performance of assistant investigation. |
