A Study On Government Lawyer System In Perspective Of Rule Of Law

In the 19 th National Congress of the Communist Party of China,“the rule of law” and “four-pronged comprehensive strategy” has been emphasized.In terms of the world,in government construction of the rule of law and to maintain the government lawyer system has become an essential institutional arrangement.Complete government lawyer system can not only contribute to the construction of the rule of law government,accorded with the rule of law and political background,comprehensive and,more importantly,through the government lawyer system form a healthy balance in the exercise their functions and powers of government,makes the operation of the power to under the rule of law.From this sense,the study of the political law system theory,the comparison of different types of government lawyer system practice patterns,for consummates our country the government lawyer system,improve the level of government under the rule of law construction in China,it is of important theoretical significance and practical value.From a practical point of view,the government lawyer system is not a new concept in our country.As early as the 1990 s,some pilot areas of the government lawyer system were started in our country,including Xiamen,Guangzhou and Yangzhou After nearly thirty years of practice,various pilot models have been formed in various places.However,at present,there is no confirmation of the legislative level in practice in our country's legislation,and the existence of the current government lawyer system in our country many uncertainties need to be further established.At the Fourth Plenary Session of the 18 th CPC Central Committee,we clearly proposed the goal of establishing and improving this system as an important measure for realizing rule of law in our country.It can be said that in the modern blueprint for the construction of government by law,the government lawyer system is considered as one of the key issues.Therefore,this article intends to select the government lawyer system as the research object.Under the background of the reform of the government by law,the system of construction and improvement of the road made a little suggestion with reference value.In general,this paper mainly divided into four parts:The first part of law system related theory foreshadowing for the government.Discusses the concepts of first to clarify the government lawyer premise and starting point,through the interpretation of the concept of scientific theory,and through this system related comparison and analysis of the concept of other can make the research object of this article,the government lawyer system is more clear.Based on this theory,the author from the responsibility of the government by law requirements and the responsibility of the government lawyer value as the center of gravity,and significance of the establishment of the government lawyer system detailed argument;The second part is to investigate the government lawyer system of our country tested in some typical regions.This paper selected the model of Xiamen,Guangzhou,Yangzhou model three main pilot,respectively through the textual research of the pilot system of their respective operation characteristics and advantages,and the horizontal contrast and summarized the pilot has the characteristics of the present in our country,and the analysis of the main restricting factors to practice in the pilot,in order to better realize the practice of our country government lawyer system constraints;The third part examines government lawyer system models adopted in Hong Kong Special Administrative Region,the United States and Singapore,and tries to find out what are worth to learn from or to be introduced in our country.The fourth part concentrates on how to construct our governmental lawyer system,such as legislation,motivation,position,etc.of governmental lawyer are discussed and some countermeasures are presented.
