With the development of society and economy,the acceleration of urbanization and the development of the real estate industry,more and more land is being expropriated.How to allocate compensation for land acquisition has become a concern for landless farmers.Although China's constitution and related laws and regulations clearly stipulate that women enjoy equal rights to land contractual management,use of homestead land,rural collective income,and compensation for land expropriation,the equality of men and women in law and de facto inequality are still prevalent.This is mainly manifested in the fact that the rights of women in rural areas to participate in the allocation of compensation for land acquisition are infringed,which seriously restricts the development of women and affects social harmony and development.Combining the field surveys in Xiamen,this paper analyzes the specific performance of gender inequality in the village-level distribution of compensation fees for land acquisition in China.It was mainly reflected in the marriage daughter and their children,divorced or widowed women and their children,and the coming husbands living in the village of the woman and their children,whose rights to participate in distribution are deprived or restricted due to gender differences.Combining field visits,China's current situation,and related research results,this paper analyzes the causes of gender inequality in the distribution of compensation for land acquisition from several perspectives:historical culture,economy,politics,government behavior,and legal systems.In terms of cultural concepts,it is mainly influenced by the tradition of male patriarchal thoughts such as "male esteem and inferior female patriarchy" and marriage habits of husbands and grooms,and the education level in rural areas is not high.The villagers' legal awareness is not strong,and rural women's awareness of rights and the awareness of rights protection are low;in terms of economic benefits,it is under the influence of the limited land resources and the direct benefits of the compensation methods for land expropriation,the economic self-interest behavior for the pursuit of personal interests and the maintenance of limited collective resources by traditional rural collective economic organizations.As regards political participation,the low level of women' s political participation and the lack of female spokespersons in the formulation of the plan,women are excluded from the voting plan for the allocation plan,there is a lack of guidance and review over the allocation of land compensation fees in terms of government behavior.In terms of the legal system,compensation for land acquisition Village-level distribution legislation is imperfect and collective Members qualification standards are not uniform,the relevant law-making lacks of gender perspective,the laws are not strong operability as well as conflicts between the laws and institutions and so on.Through the analysis of the specific manifestations and causes of gender inequality in the village-level compensation for land acquisition in Xiamen,this paper believes that the solution to the problem of gender inequality in the allocation of compensation for land acquisition is the key to the qualification of"villagers".At the same time,we must strengthen the adjustment of the concept of inequality between men and women in traditional culture,promote the change of gender concept in rural areas,increase the participation of rural women in political enthusiasm and political participation,and promote the level of rural women's political participation;government departments should actively work to provide prior guidance for the distribution of village-level compensation for land acquisition,and review and supervise the distribution plan formulated under the autonomy of the villagers.Also strengthen the legislative perfection of village-level distribution of land acquisition compensation fees,unify the qualification standards for the membership of collective economic organizations.improve the relevant laws and regulations on the allocation of compensation for land acquisition and the protection of women's land rights and interests,and formulate detailed implementation rules.Enhance gender perspectives in legislation and adapt conflicts and conflicts between laws and regulations.
