Research On The Informed Criminal Law Of The Qing Dynasty

"Informed" means to understand the circumstances of the event.The "Informed" in <The Great Qing Decrees> appeared 787 times,including the "knowledge" of the two words of the law and the sample text of 305.In this paper,the provisions of the criminal law in the Qing dynasty about the "informed" carding,analysis,reveals the appearance of "Informed" in different crime,the offender commits a crime,or before implementation of the crime,the background of his own behavior,behavior,the behavior of objects such as aware,then think about the law in the Qing dynasty in the knowledge of the influence of the criterions for the conviction.The main contents of this paper are:First,The behavior of the actor after the knowledge.How the informed behavior is applied and reflected in legislation and judicature.Because knowledge of crime can be divided into the three main behavior,longitudinal,hiding and shield the hide and behave somewhat similarities,so the author in the act of shielding on the corresponding analysis.Second,the Subject classification of informed crime.This paper divides the subjects into three categories: officials,family members(relatives)and ping people,and the different crimes of knowledge are classified through these three categories.And through the types of crimes,we can analyze the influence of the informed agent on the case after knowing the plot of the case.Third.Informed conviction and sentencing analysis.According to the difference of the identity and behavior of the person with knowledge of the situation,the conviction situation of informed crime was analyzed through the Qing dynasty law and the concrete cases.In addition,through the different punishment methods of the actor,it is analyzed whether the punishment of the punishment plays a certain role in the prevention of the punishment,so as to guide the person's inner concept and the behavior of the standard person.
