Study On The Problem Of Zombie Enterprise Exit

Nowadays,zombie companies are a "cancer" of social and economic development,which are faced with some general problems in all provinces and cities: clean up hard,and have large quantity.In view of the management of zombie companies,some]regions have introduced some corresponding countermeasure,which control the growth number of zombie companies,but as for the damage for zombie companies,the governance effect is not obvious.In order not to waste social resources,for the sake of economic benefit,it is urgent for zombie enterprises to retreat.In this paper,by analyzing the current situation of the zombie companies,I find the problems in the exit process of zombie companies,from a legal point of view;I give some advice of the exit process of zombie companies,to build a harmonious and stable social environment.Innovation point of this article is that in the exit process of zombie companies,from the angle of responsibility,concretely analyze that responsibility subject mainly should assume what responsibility,how to take responsibility,and find in the exit process of zombie companies each responsibility subject should be accountable to people,so as to promote the zombie companies out of work.To repel zombie companies,we must perfect the corresponding laws and regulations,this needs the government and related departments to work together;at the same time,require companies to cooperate,each subject only do their job better,so as to maintain a balance between the interests in the market operating and execution of the law.In the first part of this text,we will discuss the definition of the zombie companies,summarizes the more authoritative,more scientific method to recognize the zombie companies,the purpose is to clearly define,so as to find the right way to repel zombie companies.In the second part of this text,we will mainly discuss the problems in the disposal of the zombie companies;currently the zombie companies are faced with some general problems: have large quantity,clean up hard,and responsibility subject in the exit process of zombies companies can not shoulder the responsibility,and so on.At present,in the process of practice,repelling zombies companies still exist many obstacles,such as excessive government intervention has resulted in zombie companies continue to claim to the government,"vampire",zombie companies are deadlocked,deathless,division of the court is unknown,between various departments cooperate not close,zombie work of enterprise bankruptcy drive slowly,too much waste of judicial resources,it is difficult for zombie enterprises to exit the market stage.In the third part of this text,it is discussed that the zombie companies exit is the strong requirement of social development,the zombie companies exit is conducive to social stability,is good for protecting the interests of the worker,the more conducive to build a harmonious economic environment,the zombie companies exit is not only the need of economic development of the enterprise,but also the inevitable choice of reasonable allocation of social resources.The last part of this article,the author puts forward the suggestions to repel zombie companies.Firstly,we must clear the responsibility subject,and the specific departments should take each responsibility,to strengthen the close cooperation,and it is necessary for various departments to bear the main responsibility,so as to let each department play the largest role,which is very important for zombie companies to exit.Cleaning up the zombie companies can not only let the court and related department to take responsibility,just rely on the power of the court judicial resources can lead to cost too much,and clean up of the zombie companies is not much.Zombie companies withdrew from the wide range,huge influence,the government in the process of repel zombie companies also want to take responsibility.In enterprise management,enterprise executives should be actively cooperate with the court and government work,clear each department,each subject's responsibility to repel zombie enterprise has a huge role.Bankruptcy administrators also play a huge role in the bankruptcy process,and improving the selection of administrators is a faster and better way to promote the exit of zombie enterprises.
