Research On The Perfection Of China's Foreign Investment Security Review System

In the era of globalization,international capital flows have become increasingly frequent,almost every country is faced with the conflicts between the foreign investment and national security,the importance of national security review of foreign investment legislation is gradually valued by governments.With the deepening of China's reform and opening up,China has gradually abandoned the traditional strict foreign investment approval system,the introduction of foreign investment before the national treatment.In this context,to give up other restrictions on foreign investment at the same time,the national security review of foreign countries will become one of the major measures to be adopted.Although China has set up a national security review of foreign system,but the low level of legislation,foreign national security implementation condition rule has many shortcomings,need to rethink it,so as to provide suggestions for its improvement.This paper is divided into five chapters,the main contents are as follows:The first chapter describes the research background,research methods and research objectives.The second chapter is mainly about the status quo of China's foreign investment security review and problems from the origin and development stage of China's foreign investment security review,with China's foreign investment security review of relevant laws and the existing problem analysis.The third chapter from the perspective of comparative law,the United States,Canada and Japan and other countries of foreign mergers and acquisitions of national security review system.The study of this system is based on four aspects:the subject of review,the object of review,the standard of review and the procedure of review.The fourth chapter analyzes the similarities and differences between different countries in the subject of examination,the object of review,the standard of examination and the procedure of review,and has made reference to the improvement of the security review of foreign investment in China.The fifth chapter carries on the above analysis,from the foreign security review system of these four aspects put forward their own perfect suggestions.
