The New Changes In The U.S. Foreign Investment National Security Review System And My Country's Response

President Trump of the United States signed the Foreign Investment Risk Review Modernization Act of 2018(hereinafter referred to as the FIRRMA)on August 13,2018,which is a significant modification of national security review system of foreign investment in the United States.FIRRMA further strengthen the review of foreign investment in the perspective of national security made by the CFIUS,which leads to more substantial difficulties for Chinese enterprises' investment in the United States.On the other hand,some system design in FIRRMA has referential value for the legislative perfection regarding the national security review system of foreign investment in China.This paper firstly researches on the connotation of the national security review system of foreign investment to define the range of study of this paper.Then the emergence and development of national security review system of foreign investment in the United States are elaborated as three stages and the elaboration and evaluation of the development of such system in its different stages will be the focus.The third part of this paper is the elaboration of the FIRRMA.In this part,this paper,combining the latest review deals,introduces and evaluates the major modifications made by the FIRRMA and researches on its effect on Chinese enterprises' investment in the United States.Based on the above elaboration,this paper,considering the current legislation and design regarding national security review system of foreign investment in China,analyzes the referential value of FIRRMA to the legislation and system design in China.In addition,this paper,considering the trend of Chinese enterprises' investment in the United States and the lasted development of the national security review system of foreign investment in the United States,proposes coping strategies for Chinese enterprises' investment in the United States.
