Housing online short-term rental transactions,referred to as online short-term rentals,are typical representatives of the "sharing economy" in the accommodation industry.With the rapid development of the Internet and the popularity of mobile communication tools such as smart phones,the technology environment required for accommodation sharing has matured.The fiery concept of "shared economy" and the diversified consumer demand for accommodation also provide a good social atmosphere and development opportunities for accommodation sharing.At the same time,the high vacancy rate in urban housing has also boosted the development of online short-term rental transactions.Due to the intervention of the Internet,the legal relationship of housing online short-term rental transactions breaks through the regulatory system of traditional civil and commercial law,and there are a series of problems in its legal regulation.It is undeniable that,compared with some countries and regions in Europe and the United States,China's legal regulations for housing online short-term rental transactions are also lagging behind.The author believes that the housing online short-term rental transaction as a shared economy of the accommodation industry,its legal status should be recognized by the state and the government.Therefore,this paper intends to conduct in-depth analysis of the status quo of legal regulation of domestic short-term rental transactions in domestic housing,and in conjunction with the regulatory experience of out-of-area housing online short-term rental transactions,summarizes the main problems in the legal regulation of domestic short-term rental transactions.Solutions.The full text is divided into four parts:The first part is an overview of housing online short-term rental transactions.This article summarizes the five characteristics of online short-term rental transactions for homes by analyzing the concept of online short-term rental transactions.By analyzing the typical business model of online short-term rent,the legal structure of housing online short-term rental transactions is divided into internal legal structure and external legal structure.The second part is the current situation and existing problems of legal regulation of China's housing online short-term rental transactions.This paper analyzes the current situation of legal regulation of online short-term rental transactions of houses,and concludes that the problems in China's online short-term rental transactions lie in the lack of administrative supervision,inadequate protection of consumer rights,and unbalanced neighboring interests.The third part is the status quo of the legal regulation of overseas short-term house lease transactions.This article analyzes the status quo of legal regulation in the United States,Europe,Taiwan and other places,thus summing up the legal regulation experience that is beneficial to our country.The fourth part is to improve the legal regulation of China's housing online short-term rental transactions.This article learns from the legal regulation experiences of overseas short-term house lease transactions,and concludes that China should improve the legal regulation of China's housing online short-term rental transactions from three aspects:the implementation of administrative supervision,strengthening the protection of consumer rights and improving the existing legal norms.
