Since the Central Committee of the Communist Party of China and the State Council proposed the "sanctioning of the three powers" in 2014,the land management right holders have been able to use the land management rights to make mortgage loans to financial institutions.Although the central government has vigorously promoted mortgage loans for rural land management rights in its policies,it has been able to continue to advance in all pilot regions.However,due to the current laws and regulations in China that explicitly prohibit the mortgage of rural land management rights,this has led to the change of mortgage loans for rural land management rights.It is extremely difficult,and it also leads to a series of issues such as whether it is in accordance with legal precedence or policy priority,whether mortgage or mortgage is forbidden when rural land mortgage rights mortgage disputes arise.To this end,it is necessary to further analyze the origin of rural land management rights and current policies.Secondly,through the analysis of problems such as legal systems and mortgage loan procedures in mortgage loans of rural land management rights in various pilot regions,the analysis of various types The status quo of the problem and the methods to solve the problem,seeking personal advice on mortgage loans for rural land management rights in China,and providing a reasonable and legal way for the transition from a big agricultural country to a strong agricultural country,and providing good agricultural modernization for China.surroundings.In the first part of the thesis,the necessity and importance of writing this article are explained by introducing the background of the topic and the significance of the topic.Secondly,the innovations and deficiencies in this article are introduced,which pave the way for the overall writing direction of this article.The second part introduces the basic theories and development status of rural land management rights,and analyzes the various requirements for rural land management rights mortgage loans.The third part mainly analyzes the pilot conditions of Kaizou County in Chongqing,Baofeng County in Henan Province and Shouguang County in ShandongProvince,and draws conclusions and shortcomings.The fourth part analyzes the predicament of China's land management right mortgage loan system,and analyzes the superiority of the land management right mortgage loan pilot area in China,and derives a series of experience instructions from it,and on this basis,from our country's rural areas.The status quo of mortgage loans for land management rights starts with a brief analysis of the various issues that exist at this stage.The fifth part mainly analyzes the problems existing in the previous articles,and proposes corresponding personal opinions and solutions.It mainly puts forward my suggestions from the aspect of legislation and corresponding system design and other related regulatory issues.The last part mainly summarizes the problems and solutions in the previous article and draws the corresponding conclusions.
