Research On The Practice Of Project Cost Appraisal And Pre Litigation Professional Mediation

China's economic take-off has led to the vigorous development of the construction industry,and the increasing development of construction projects also aggravates the contradiction.The characteristics of engineering disputes are its high value,complexity and professionalism.In litigation,the judge will open the project cost judicial appraisal procedure due to the shortage of cost knowledge.The judicial expert opinion on project cost almost determines the final direction of the case,but there are many problems in the judicial appraisal of project cost.Judicial appraisal project cost is a new type identification in addition to the "three types " identification,it's weak in the constraints of laws and regulations,maturity of practice and more professional problems.Based on the development and current situation of domestic cost judicial appraisal,the author makes an in-depth study on several kinds of problems that are prominent in the judicial appraisal of project cost.Based on theoretical study,this paper studied the present situation of the domestic and foreign judicial authentication project cost in China after the deep analysis on the current situation of judicial appraisal,puts forward the practical problems in the current judicial appraisal cost.This paper focuses on the selection of the cost judicial expert,the professional level of the appraiser and the development of the project costprofessional mediation before litigation.In this paper,the author analyzes several kinds of problems in detail,and then puts forward the processing path of the practical problems after the main influencing factors are determined.In actual practice,the author analyzes three problems with different methods: on the engineering cost judicial appraiser certification system,design the certification process,and the engineering cost appraiser's registration and management are proposed.Combined with the case for the current project cost practice of judicial authentication problem to discuss the solution the similar problem applied to the case,and innovate the cultivation of engineering cost appraiser method.In the study of the engineering cost professional mediation before litigation,the author combined theoretical analysis to propose the engineering cost professional mediation before litigation.This paper analyzes the feasibility of professional mediation before litigation implementation in China and puts forward the realization path of the professional mediation before litigation mechanism.Based on the form of industry organization the author analysis the condition and setting the process for carring out activities of the professional mediation before litigation.
