With the continuous development of the economy and the improvement of people's living standards,the tourism industry is rapidly developing.As a tertiary industry,tourism has become an important engine in the development of the regional economy because of its high value-added features.The development time of modern tourism in our country is short and the development of the tourism market is not perfect.There are still many problems in the tourism market,and tourism regulations still need improvement.In the tourism market,“zero and negative fee” has always existed as a business model.Under this business model,there are many unfair competition acts.These unfair competition actions seriously interfere with the market's competitive order and damage.The interests of legitimate operators.Unfair competition has interfered with the order of competition in the market.The unfair competition behavior under the "zero and negative fee" has existed for a long time in the tourism market,and we need to strengthen governance.The unfair competition in the tourism market under the "zero and negative fee” mainly includes commercial bribery,false propaganda and defamation of goodwill.These behaviors seriously disturb the market order,and need legal regulation urgently.As a special law of tourism industry,tourism law has many shortcomings in regulating these aspects.This article will find out the differences between them by comparing the law of tourism and the law of anti unfair competition and find out the shortcomings in the legal regulation.Learn from the provisions of the anti unfair competition law to make up for the deficiency of the regulation of tourism law.This article will also discuss the causes of the indiscriminate competition behavior in the “zero and negative fee”,and propose reasonable suggestions on the governance of the unfair competition behavior under the “zero and negative fee”model.This article mainly discusses from the following four parts:The first part mainly discusses the behavior of unfair competition existing in the tourism market under the “zero and negative fee” and defines the nature of its behavior.The main acts of unfair competition include commercial bribery,false publicity,and defamation of goodwill.The main manifestations of unfair competition under the “zero and negative fee” were discovered,and the characteristics of unfair competition behavior in the tourism market were summarized to enable targeted responses.The second part mainly discusses what regulatory measures are in place in China's current laws against unfair competition in the tourism market.Comparing the regulations concerning unfair competition in the "Tourism Law" and "Anti-Unfair Competition Law",we found that the existing "Tourism Law" was inadequate in regulating acts of unfair competition.Through comparison,we found that the "Anti-Unfair Competition Law" can be used for reference to improve the provisions of the "Tourism Act."In the third part,the article will explain the reasons for the unfair competition behavior in the tourism market caused by the “zero and negative fee”.It mainly discusses the legal provisions,the characteristics of tourism products,and the information asymmetry of the tourism market.Only by finding the cause of the unfair competition behavior under the “zero and negative fee” model can we better regulate the behavior.In the fourth part,the article proposes the regulation of unfair competition behavior in light of the causes of unfair competition in the tourism market and the inadequacies of legal regulations.It makes specific recommendations from the aspects of detailed legal regulations,rules for improving industry access,and strengthening the construction of industry organizations.It makes specific recommendations from the aspects of detailed legal regulations,rules for improving industry access,and strengthening the construction of industry organizations.
