Tourism, which has always been regarded as "sunrise industry" and "smokeless industry",plays an important role in today's world economy. As a developing country, China is rich in tourismresource, and has great potential in tourism industry. Tourism economy contributes a lot to the boomof the relative industries, expanding employment, increasing fiscal revenues and promoting thecommunication with other countries in the world.In recent years, with the rapid development of tourism economy, tourism brings entertainmentto everybody, also exposed many disadvantages in the developing of tourism market,such as unfaircompetition which seriously disturbs the competition order,infringes upon other tour operators'rights and interests, at the same time, the protection of tourists' legal rights has been drawn a lotsattentions by people.We should deeply analyze the cause of unfair competition and the presentsituation of protecting tourism consumers' rights, strengthen legal regulations on tourism marketunfair competition, perfect the legal system on consumers' rights protection.In the forward of this paper, introduced the background and research significance of topic.Part Ⅰa s a theoretical introduction, gave a brief introduction of tourism-related issues, includingthe concept and characteristic of tourism, tourism market and tourism consumption. PartⅡsummarized the present situations of our country's tourism market, among them including variousacts of unfair competition and current state of tourists' legal rights protection system, and analysedthe causes of this two issues, market failure and the legal defects. Part Ⅲdrew on foreign countries'regulative and legislative experience of tourism market, then compared China's present situation oflegal regulations with foreign countries'. This paper aimed to combine their experiences withchina's actual situation, and improve and perfect China's legal system of anti-unfair competitionand consumers' protection. In partⅣ,according to the research and analysis about regulativedefects in former parts, aimed to solve these problems by such measures: for tourism unfaircompetition,establishment of tourism information disclosure system, perfection of tour guide salaryprotection system and strengthen the law enforcement of anti-unfair competition acts; for theprotection of the tourist's rights and interests, put forward some suggestions--regulating the tourismcontract, and perfecting settlement system oftourism disputes.To purify the competitive environment of the tourism market is not only theoretical issues,butthe actual operation of the practical needs. The protection of the tourism consumers' legal rights andinterests of the tourism is not only for individual's interests, but an important indicator of marketdevelopment, social progress. It is hoped that promote the further development of China's tourism market by many efforts.
