Research On The Criminal Regulation Of Doping Offences In Competitive Sports

Dope is regarded as an enemy of competitive sports.AntiDoping has been a hot issue in sports law for a long time.Up to now,it is hard to get rid of and has caused much harm,such as deviating from the fair competition spirit of Olympic,destroying the normal development order of sports competition,damaging the image of country,doing harm to athletes' physical and mental health an so on.Doping offences in competitive sports refers to the general term of the serious acts such as intentional and illegal use of dope by athletes,auxiliary personnel or units of athletes to induce,instigate,deceive,or compel athletes to use dope.In order to regulate and control doping offences in competitive sports,the advanced countries such as Italy and Austria have taken corresponding criminal legislation measures.In China,doping offences are prosecuted for criminal responsibility in the broad sense of the criminal law,but not explicitly stipulated in the current criminal law,so there is an opportunity for the criminal regulation of doping offences in competitive sports.It is a cross topic of sports law and criminal law.Based on the principles of sports law and criminal law,in interdisciplinary multidimensional perspective,the thesis mainly includes “the summary of doping offences in competitive sports”,“the regulation basis of criminal law against doping offences in competitive sports”,“China's current situation of the rules and regulation” and “tentative ideas on the regulation of criminal law against doping offences in competitive sports”.It starts from the definition of doping offences in competitive sports and then focuses on the theoretical and realistic basis of criminal regulations.To make a comprehensive design for the criminal regulation system of doping offences in competitive sports,it is necessary to analyze the current situation of this issue and the main problems,by studying and comparing the practices of foreign countries.Regulation system of criminal law against doping offences in competitive sports mainly includes setting up “the guiding principles of criminal law regulation of doping offences in competitive sports”,clearing “the charges and penalty classifications of doping offences in competitive sports” and “the constitutive requirements of doping offences in competitive sports”.The study is aimed at not only finding the way of the regulation of criminal law to curb the abuse of dope,but also protecting the legitimate rights and interests of athletes and purifying the sporting world.
