On The System Of Life Imprisonment

The amendment to the criminal law of China(9)has created a new system of "life imprisonment without commutation or parole".In the context of the global restriction and abolition of the death penalty and the light punishment of China's killing and careful killing,the system of life imprisonment is of great significance to the future reform of the penalty in China.Full text consists of five parts,the first part of introduction mainly introduces the selection of life imprisonment topic background and significance,domestic and foreign research present situation and the analysis about life in prison,the research content about life in prison and writing methods.The second part first introduces the concept and origin about life in prison at home and abroad,and then analyze the theoretical basis of penalty,mainly introduced the life imprisonment and retribution punishment,punishment,the relationship between the comprehensive theory of punishment of utilitarianism.The theoretical basis of punishment is abundant,but on the basis of the existing penalty system,it can realize the purpose of preventing the punishment.The third part introduces the application of life imprisonment outside the region,and introduces the difference between life imprisonment and life imprisonment in China.The fourth part sums up the analysis our country existing in the dispute applicable to life in prison in the judicial,life imprisonment is a kind of life imprisonment,for the punishment of nine effect of corruption and taking bribes was sentenced to the private immediately before guilty of retrospective affect,and effective for punishment take nine previous corruption criminals sentenced to death without retrospective.If only apply to the field of corruption crime,its value can not be well reflected,finally out of consideration of perfecting our country's penalty structure,put forward to set life imprisonment to independent mitigation,set shall not be commuted to life imprisonment,parole and commutation or parole two levels may not be.At the request of the criminal policy of leniency" in our country,the application scope of life imprisonment should be expanded at two stages.
