Legal Guarantee Of Police Law Enforcement Authority

The authority of police law enforcement is a form of legal authority and public credibility of the state.Good public order and the protection of civil rights require the authority of law enforcement by the police.However,from that present situation of police law enforcement,the frequent occurrence of the attack,the large number of malicious complaints,the declining public confidence in the law enforcement of the police,and the continued increase in the negative evaluation of the social security leading to the lack of authority of the police in China.The law is the most important means of ensuring that the police enforce the law.However,there are many shortcomings in the existing laws,and the guiding function and the safeguard function are softened.Through the analysis of the concept of police law enforcement and the legal provisions of our country,this paper tries to find a solution for the protection of the authority of police law enforcement from the level of rule of law.The full text is divided into five parts:The first part is an overview of police law enforcement authority.First,the meaning of police law enforcement authority is explained.A preliminary Analysis and determination of what is Police Law Enforcement Authority.Then it puts forward the theoretical basis of the police law enforcement authority.From four aspects: the theory of rule of law,the theory of human rights protection,the theory of power restriction and supervision,and the theory of law enforcement credibility,it provides theoretical support for establishing the authority of police law enforcement.Finally,the present situation of our country's police law enforcement authority is analyzed,and the conclusion that our country's police law enforcement authority is lacking is obtained.The second part is the current situation of our country's police law enforcement authority.First of all,the law and regulations related to the police law enforcement in China are described in a general way.On this basis,we focus on the level of police enforcement,the level of police duty defense,the level of Internet rumors related to police enforcement,and explore the protection of law and the softening of regulation.The third part is the perfection of the system of police law enforcement standardization.Based on the standardization construction of police law enforcement in China,three suggestions are put forward to perfect the standardization of police law enforcement behavior,to perfect the relevant laws and regulations of law enforcement,and to establish a multi-layer and feasible supervision system.We should strive to promote the law enforcement by the police and standardize the law enforcement.The fourth part focuses on the identification and guarantee of police duty defense behavior.First of all,the establishment conditions of the police duty defense behavior should be made clear.On this basis,based on the deficiencies of Chinese law,the legislative and institutional suggestions are put forward from the aspects of the perfection of laws and regulations and the safeguard mechanism of police duty defense behavior.The fifth department is the police law enforcement related network rumour management.From the media,the public,the law three levels of interpretation.The following conclusions are drawn: The media should be responsible for being a "gatekeeper";The public should improve the network media literacy;The law should protect the freedom of speech and strengthen the regulation of online rumor.
