Research On The Legal Protection Of The Police's Law Enforcement Power

In view of the problems existing in the exercise of the law enforcement power of the people's police in the new era,this paper analyses and summarizes the problems existing in the police law enforcement power and the insufficiencies in the guarantee through the in-depth excavation of the theory and many problems in the practical practice,and the incomplete and incomplete provisions existing in the current legal provisions.By comparing the system contents of advanced countries and regions,starting from theory,through the analysis of specific problems,we can find out the ways to solve the problems in practice.The People's Police Law of our country stipulates the legal responsibility of the police.At the same time,the Criminal Law and the Law on Punishment of Public Security Management require the scope,duty and method of the police's law enforcement power.However,the whole system of police law enforcement has not been formed,which leads to the emergence of multiple law enforcement and abuse of power in the process of practice.The phenomenon of force emerges one after another.With the development of social governance system,social contradictions are aggravating.There are more and more cases of police resisting law enforcement in the process of law enforcement,but there are fewer remedies for police being infringed in the process of law enforcement.This article uses empirical research method and comparative research method to analyze the crux of frequent cases of infringement on the authority of law enforcement and find solutions to specific problems in accordance with China's actual situation,taking the difficulties faced by the police law enforcement power in the process of operation and law enforcement activities as the main breakthrough point,so as to better maintain it.The authority of police law enforcement and the image of police law enforcement should further promote the process of governing the country by law,and seek a new way and new method to guarantee the power of police law enforcement from the level of rule of law.
