Various operating methods have emerged with the development of economy.The pyramid selling of developing offline sales and constituting a hierarchical relationship to reduce intermediate links,was introduced into China in the late 1980 s and early 1990 s.People initially sold goods in the name of direct sales,but generally the act evolved into a pyramid sales crime characterized by pure “human-human” mode.The forms of pyramid sales crimes have constantly changed with more than 20 years of development.The traditional gathering pyramid mode that brainwash people in a limited space and then develop offline personnel still exists,and the new web-based pyramid continues to spread,both seriously jeopardize the market economic order in China.In this paper,it starts from the traditional human-aggregate pyramid crime in China,then analyzes the current situation of such crime,and then puts forward the corresponding investigation countermeasures.In this paper,it analyzes the human-aggregate organization and lead pyramid sales crimes based on the research ideas of asking questions,analyzing problems,and solving problems.The first part defines the concept of human-aggregate organization and lead pyramid sales crimes,then identifies what kind of criminal activities belong to them.The second part introduces the development stage and history of pyramid sales crime,then introduces the development history and form of human-aggregate organization and lead pyramid sales crimes,and their main characteristics.The third part interprets the legal provisions,understands the basis for identifying pyramid sales crime,and then analyzes the differences between illegal detention and fraud behavior in money raising involved in pyramid sales crimes,so as to guide the characterization of cases and evidence collection.The fourth part elaborates the specific investigation methods of collecting intelligence cues,locking-up of pyramid place at the initial investigation,the timely arrest and collection operation,the seizure of funds,etc.Finally,it provides a guiding principles on handling such cases. |
