The public security administrative coercive measures play an important role in the administrative compulsion system.It refers to the temporary compulsory restriction or constraint and deprivation of the administrative counterpart's qualifications,property,and personal rights in order to achieve a specific administrative purpose during the implementation of administrative management.As an important means for public security organs to implement administrative management,public security administrative enforcement measures play a very important role in improving the efficiency of public security work and the realization of administrative compulsion objectives,as well as safeguarding social stability and improving people's well-being.The protection of human rights by public security administrative compulsory measures is also of great significance.Human rights are the most basic human rights,as the economy and society move forward,people's ideas and concepts have also undergone tremendous changes.Especially under the extensive influence of modern human rights movements in full swing,the state's protection of human rights has become more and more important.Safeguarding human rights has also become a prominent symbol of democratic politics in modern countries.In 2004,China officially included the “respect and guarantee of human rights”in the constitution.From then on,it opened a new chapter in human rights protection.The public security administrative compulsory measures and human rights protection are the relations of opposition and unity.The purpose of the public security administrative compulsory measures is to achieve the purpose of human rights protection through compulsory measures.This is determined by the nature of our country's socialist country and reflects the value of public security administrative coercive measures of the socialism of our country.However,we should also recognize that public security administrative coercive measures are like a double-edged sword.The good use can improve administrative efficiency and better guarantee the realization of human rights.Poor application will not only affect administrative efficiency and the government's image,but also violate human rights and disrupt social order.This article uses a contradictory viewpoint to analyze the relationship between public security administrative enforcement measures and the existence of human rights protection.It also points out the phenomenon of unbalance between public security administrative enforcement measures and human rights protection in practice,and analyzes the reasons for this imbalance,because there is no good legislation.There are many problems in the aspects of sequence,unqualified subjects of law enforcement,problems in law enforcement procedures,and lack of effective protection of police rights and interests.Based on this analysis,the author gives feasible suggestions from multiple angles.
