On Public Security Administrative Coercive Measures

Public security administrative coercive measures is a kind of important means that the public security organ realizes their administration purposes. But for a long time, deficienting at the theoretical research make the coercive measures more confused of using in practice. After " the Administrative Procedure Law " was issued in 1989, the academic circle pays more and more attention to it, various kinds of views about administrative coercive measures were borned one after another, which not only makes people understand of the administrative coercive measures more deeply , but also lays the foundation further for studying public security administrative coercive measures and accelerating public security administration's legislating. But different views make people understand public security administrative coercive measures more difficult, and the discussion to the relevant problem awaits to deepen too. So, I describe public security administrative coercive measures from three respects emphatically in the article. First of all , in the first part of the thesis, the concept, connotation, and kinds of public security administrative coercive measures are defined and analysed about in order to construct the theoretical foundation of public security administrative coercive measures, and find the theoretical foundation for the practical application of public security administrative coercive measures; In the second part, the current situation of the legislation and enforcement in public security men's administrative coercive measures of our country are analysed, the problems existing in practical are found out and the reasons are analysed; After discussing the above-mentioned , in the third part of the thesis, in view of the implementation current situations of our public security administrative coercive measures, I proposed the imagination of perfecting public security administrative coercive measures of our country from four respects. In a word, I hope that the argument proposed in this thesis can pass the inspection, and offer a better reference for realizing the governed by law of public security administration.
