Research On The Legal System Ofpersonnel Employment Contract In Institutions

Under the socialist market economy system of China,the reform of institutions has been continuously promoted,and the reform of the employment contract system of the personnel of the institutions has been one of the important contents.In order to solve the problems existing in the reform process of employment system in our country,this paper uses the research methods of value analysis,system analysis,comparative study and literature analysis to clarify the value of the existence of the legal system of personnel employment contract,and clear the position of the legal system of personnel employment contract.In this paper,the employment contract is defined as the legal form of the personnel employment system.It is one of the three important legal systems in the allocation of human resources in China(namely,the labor contract system of equal consultation,the civil service system with administrative color,and the personnel employment contract system of this article),and acknowledges the coexistence with the civil service system and the labor contract system of the three parties.Noodles By comparing personnel employment contract with related concepts,this paper analyzes the characteristics of personnel engagement contract in terms of theoretical basis,value concept and practical application.Then,it explains the content and system of the legal system of personnel employmentcontract in institutions,reports the present situation of personnel employment contract in institutions,summarizes the existing problems in the legal system of personnel employment contract,and puts forward three aspects of perfecting the legal system of employment contract in our country,strengthening the supervision and management of personnel employment contract and perfecting the handling mechanism of personnel dispute.Some suggestions on the legal system of personnel employment contract in China are made.
