Research On The Hearing System Of The Arrest During The Procuratorial Tache

As a mandatory measure for the deprivation of the suspect's personal body,thereby ensuring the smooth conduct of the proceedings,because it has severe personal freedom restrictions,making it the most stringent litigation coercive measures,if not careful to use the easy Personal freedom caused by infringement.Under the operation mechanism of arrest and hearing,the litigation participants can fully participate in the operation of the right of arrest and,to a certain extent,make up for the relatively shortcomings and deficiencies of the arrest and operation.This reform measure has very important practical significance to raising the credibility of procurator and meeting the requirements of citizen participation in judicature.This paper first summarizes the arrest and hearing system,in addition to analyzing its specific meaning,focusing on the value level and technical aspects of its function.Second,analyze the realistic background and legal basis of the establishment of the hearing and hearing system.Secondly,combined with the specific use of the foreign arrest and hearing system collected and sorted out,and the current practice of arresting the hearing system,the paper further analyzes the dilemma of the system in operation.Finally,it puts forward some suggestions on how to build a system of arrest and hearing that is suitable for China's national conditions.
