Research On Legal Issues Of Governmental Supervision In PPP Projects In China

Since 2013,China has made great progress in the development of PPP.PPP has achieved a great progress,as it can reduce governmental financial pressure and accelerate the development of infrastructure and public services,China's PPP projects have gradually increased.The PPP project has its own special characteristics,and its supervision is also special.In the PPP project,the government is a participant and a supervisor of the project,the supervision may have some problems.This article discusses the issues in PPP projects in China,studies the modes and legal systems of PPP in foreign countries,and proposes solutions to the legal problems in China's government supervision.This article is divided into five parts.The first part mainly introduces the topic,the significance of the topic and the literature review both at home and abroad.The purpose is to explain the necessity of the research on the supervision of the PPP project.The second part is to systematically introduce the supervision of PPP projects,start with the connotation and characteristics of PPP,and then introduce the meaning and necessity of PPP project supervision.PPP projects have long cycle,need complicated technology and are related to citizens.The supervision is indispensable.The third part mainly discusses the legal problems existing in the supervision,such as the imperfect legal system of PPP supervision,the unreasonable allocation of supervision power by the government,the lack of external supervision mechanism,and the incompleteness of the legal mechanism of the regulatory agencies.The fourth part introduces the legal regulation of foreign PPP supervision.Countries such as Britain and Australia have relatively successful experiences in the development of PPP,and have reference value for China's legal framework.The fifth part mainly explains the suggestions,such as the legal supervision system should be three-dimensional,to improve the supervision system,to set up a special PPP supervision department,to promote the external supervision system,and to improve the legal accountability of the supervision mechanism.
