Research On The System Of Victim Assistance For Rape Crime In China

As a sort of violent case,forcible rape has its own characteristic.Compared with other cases,victims in forcible rape get severe injuries both physically and mentally.With the development of the victimology,the construction of protecting victims has arisen public attention across the whole society.The United nations laid down some programmatic documents,many countries and regions then set up the system of victim assistance for criminal victims and give victims special protection in proceeding,litigious rights,spiritual reparation,national compensation,social aid were also set up to protect and help these victims in all aspects.But in our country,not only is the litigation of the forcible laking in legislative design,but the juridical practice also does not take forcible rapes into consideration when it comes to national compensation,the social still pay little attention to these victims.Due to such severe consequences,this article aims at suggestions on the protection of victims.This passage is divided into four parts: The first episode: analysis the concept and characteristics of the rape victims.And the division of victims,based on detailed studies and statistics,basic explanation will be done as follows.And then the passage will comb the history and development of the theory and analyze the characteristics as well.The passage will also introduce the United nations charter about the victims.The second episode: introduction and analysis of the rescue system in typical countries and regions,and analyze main content of the institution,including how to protect victims' litigious rights,set up related spiritual reparation,national compensation and social aid.The third episode: To introduce present system of forcible rapes in our country,and compare with that of other typical countries and regions,and then get the conclusion what problems our system is faced with.The last episode: According to the problems our country is faced with,and related content in the United nations charter,accept experience of typical countries and regions.At last,to give suggestions about how to improve our system from many aspects,including proceeding,moral reparation,national compensation and social aid.
