Dutch Drug Policy And Its Enlightenment To Drug Control In China

The Netherlands has been in control over drugs for nearly 100 years.Since the promulgation and implementation of the Opium Act in 1919,which is the first time to regulate drugs' manufacturing and trading;to the unveiling of the Opium Act Amendment in 1976,which set the tone for drug policy to public health,taking harm reduction strategy as a core;from 1990 s,the Netherlands lauched Prosecutorial Guidelines for several times in order to strenthen drug control.Transfering between “loose” and “strict”,Dutch drug policy undergone a tortuous experience,which origines from pragmatic spirit,tolerant culture,politics decentration,gentle restorative justice and so on.In the current drug policy,the Netherlands implements drugs classfication system and Coffeeshop system to guide the seperation of the drug market and drug problem;promotes drug law enforcement and drug detoxification work synergistically,strives for the combination of “strike” and “grooming” in the governance of drugs,which provide the direction for the majorization of Drug Control in China.First,drug policy should be rooted in a country's situation and drug situation,so as to be coherence,systematic and active.Second,we ought to make efforts to fill the gap in drugs classfication system,exploring how to establish drug column,drug detoxification and drug cime conviction and sentencing classfication system,finally,it is better to remove the “stigmatization” of drug problem,by introducing evaluation from the third party.We can promote the socialization of drug detoxification work,taking the source and the way out of the drug problem as breakthrough points to address both its symptoms and root cause.This article is divided into four parts.The first part expounds the basic concept and development of drug and drug policy,introducing the practice of Punitivecriminal Justice Oriented drug policy and Public Health Oriented drug policy.The second part combs the development of Dutch drug policy longitudinally,analyzing the causes behind the opean and tolerant Dutch drug policy.The third part interprets the current drug policy's basic principles and theories,hard durg&soft drug classfication system,harm reduction strategy represented by the Coffeeshop system,drug law enforcement and diversified drug detoxification system in detail,reflecting its combination of countermeasures and contradictions.The fourth part summarizes the experience and lessons of Dutch drug policy,combining the actual situation of drug control in China,puts forward some suggestions on how to control our drug policy macroscopically,match and optimize drugs classfication system,innovate the prevenient education against drugs and drug treatment & rehabilitation system.
