Research On The Protection Of Personal Rights Of Detainee In The Public Security Custody

Public security custody management is an important part of law-based governance.It is an important window to show the achievements of the construction of the law-based governance,which is related to justice and social stability.It is an important basic work of public security custody management to guarantee the personal rights of the detainee.After the reform and opening up,the work of public security custody management in China has been continuously improved,but there are still outstanding problems that need to be further improved.This article mainly consists of the following aspects:The first part is to raise the question through the typical cases of the violation of the personal rights of the detainee.The second part is the comprehensive review about the personal rights of the detainee in the public security custody,making clear concept of the detainee's personal rights through the study of detainee's scope and characteristics,and the personal rights of the detainee.The third part is to investigate the current issue of the personal rights of the detainee.This part of the main rights points right of personal security and human dignity,the right of personal liberty in three aspects,problem to be solved are put forward through the introduction of the case,and analysis reasons.In the fourth part,the author interprets the legal theory of the protection of the human rights of the detainee,analyzes the importance of the detainee personnel as the special personnel,it must be urgent and realistic to improve public security custody under the rule of law.The fifth part to complete the personal rights of the detainee by suggestion,the ways of making our country public security custody work adapt to the demands of the development including legislation,supervision,law enforcement and management.
