Research On Pilot Rerorm Of Administrative Reconsideration Committee In Ordos City,inner Mongolia

The implementation of the pilot reform of administrative reconsideration committee is for the state council to cope with the current difficulty of administrative reconsideration's running.Legal status and system design of administrative reconsideration have been being criticized,thus it is needed to make the reform of the administrative reconsideration institution system.Ordos city of Inner Mongolia has become one of the reform pilots of administrative reconsideration committee,also having been faced with the running problem of the administrative reconsideration before the reform.Then applying the reform of Harbin mode,it set up the administrative reconsideration committee in ordos municipal government,accept and hear administrative reconsideration cases that belong to the municipal government and its departments,and finally make reconsideration decision in the name of the legal administrative reconsideration organ.In the years when the pilot reform of administrative reconsideration committee has been running in ordos city,due to the reason that the right of administrative reconsideration has been relatively concentrated,the administrative reconsideration institution has been being relatively independent and introduced external members,the reform seemed really effective.And the working quality,efficiency and civil recognition of administrative reconsideration has improved.Of course,there are some problems to be solved,such as the limitation of organizational independence,the lack of professionalism and the fairness of the operation procedure.Combining experience of countries which are good at running administrative reconsideration system,such as South Korea,as well as our country's actual situation,unified system of administrative reconsideration committee can be set up based on the pilot.In this way,it would help to strengthen the independence if its legal status is guaranteed,it would ensure the professionalism if the standards are made clear,and it would finally implement impartiality if reasonable adjustment of the operational procedure can be made and the related procedures can be regulated.Achievements in the pilot reform of administrative reconsideration committee show that there is necessity and feasibility for national promotion.The summary and reflection on the pilot reform experience are conducive to a more reasonable system and make the administrative reconsideration committee of maximum function.
