Real property notice registration system is a kind of administrative act of confir ming the registration of the relative civil rights and interests.There is ofen seen cases that the civil legal relationship and administrative legal relationship coexisting.And t he conflict of the interests and the actual rights related to the act are inconsistent.That is,in the case of the dispute between the interested party in the case of the registratio n of ownership,registration of administrative litigation review and civil procedure la w action settlement may coexiste with each other and producing disputes.Thus,we n eed to consider the way out when the administrative litigation and civil action are inte rtwined when dealing with the relevant cases.This paper takes the use of comparative jurisprudence,legal positivism and other research methods,based on the existing problems as our starting point,we learn from the relevant jurisprudence and theory.T his paper expounds the relationship between civil and administrative relations in the r egistration of real property registration,and makes views on the trial of civil cases.
