A Research On Xi Jinping's Governing The Country By Constitution For A New Era

The Constitution is the fundamental law of our country,as well as the general charter for governing the country.The political report of the 19 th National Congress of the CPC points out that governing the country by law comprehensively is the essential requirement and important guarantee for socialism with Chinese characteristics.Governing the country by law should first conform to the constitution,while administrating the state affairs by law should fundamentally accord to the constitution.Since the 18 th National Congress of the CPC,General Secretary Xi Jinping has repeatedly stressed the core status of governing the country by constitution and administrating the state affairs by constitution in the legal construction of socialism with Chinese characteristics.For the first time,the Fourth Plenary Session of the 18 th CPC Central Committee adopts the rule of law as the theme of the plenum and proposes to comprehensively promote governing the country by law.In the new era,the most important thing in building the legal system of socialism with Chinese characteristics is to respect and safeguard the authority and core status of constitution,and to improve the legal system of socialism with Chinese characteristics consistently.On the basis of inheriting and developing the legal theory of Marx,Engels and Lenin,and scientifically summarizing the positive and negative experiences of CPC in the legal construction since the founding of our country,President Xi Jinping has delivered a series of important speeches on various occasions,such as the30 th anniversary conference of the implementation of the current Constitution,the 60 th anniversary conference of the founding of the National People's Congress,the 65 th anniversary of the establishment of the CPPCC,and the 95 th anniversary of the founding of the Chinese Communist Party.In these speeches,he elaborates the main content and significant role of governing the country by constitution,which has become an important theoretical guidance for legal construction of the party in achieving the "Two Century" goal and the great rejuvenation of the Chinese nation.Studying President Xi Jinping's thought of governing the country by constitution would benefit usin learning and mastering the socialist ideology with Chinese characteristics and basic strategy in the new era of Xi Jinping,help us deepen the understanding of Xi Jinping's basic methods of governing the country,and grasp the developing orientation of governance by law of socialism with Chinese characteristics.Besides,it would help us form the thinking and behavior under the belief of governance by law in practice,implement a series of work within the scope of governance by law in the new era,such as legislation,law enforcement,administration of justice,law-abiding and legal supervision,and promote the integral legal construction of the country,the government and the society.This article consists of four chapters.Chapter One: the Theoretical Origin of Xi Jinping's Thought of Governing the Country by Constitution.This chapter mainly summarizes the thoughts of governance by law of Marx and Engels,Lenin,Mao Zedong,Deng Xiaoping,Jiang Zemin and Hu Jintao,and combs the theoretical origin of Xi Jinping's thought of governing the country by constitution in the new era.Chapter Two: the Background of Xi Jinping's Thought of Governing the Country by Constitution.This chapter mainly analyzes the times background and historical conditions of Xi Jinping 's thoughts of governing the country by constitution from two aspects,the international and domestic backgrounds,as well as his personal background.Chapter Three: The Main Contents and Distinctive Features of Xi Jinping's Thought of Governing the Country by Constitution.In this chapter,it summaries the basic contents of governing the country by constitution from the aspects of the state body,the political body and the party's leadership in our country,and generalizes the distinctive features of governing the country by constitution concerning the people's principal position and leading role of governance by law.Chapter Four: The Contemporary Value of Xi Jinping's Thought of Governing the Country by Constitution.This chapter discusses the contemporary value of Xi Jinping's thought of governing the country by constitution from two aspects: the theoretical value and the practical value.
