Discussion On The Problems And Perfection Of The Investigation Of Duty Crime In China

For the past years,the procuratorial organs at all levels have conscientiously carried out the work deployment of anti-corruption by the central government so that the investigation of duty crime has made rapid progress.It has made due contribution to the construction of national anti-corruption and economic and social development.But analyzing the status quo and looking forward to the future,some bottleneck problems which restrict the investigation of duty crimes have not been effectively solved.Especially,it becomes very important that how to maintain the sustainable development of duty crime investigation under the circumstance of the new situation and new problems occur in the current judicial reform and the progress of anti-corruption,as well as the new requirements of the revised criminal procedure law.This paper focuses on the research on the transformation of duty crime investigation under the new situation.It also takes into account the investigation patterns that allow the research to go beyond the details of the investigation procedure or the investigation.It can focus on the fundamental characteristics of investigation procedure or behavior,which makes this paper more significant.At present,most duty crime investigation departments still have many problems,such as outdated conception and method,dispersion of power,disability,and inadaptability of system and lack of influence.It is the time for change.In the dissection of this paper,the writer has surveyed a lot of theses and data and use the empirical analysis method and the field research method,which is discussion with the criminal investigators in the grass-roots level.In addition,this paper uses the method of value analysis,analyzing the concept of fairness,justice,efficiency and so on.In the end,this paper also tries to explore the theoretical basis of traditional and routine investigation experience,in order to improve the self-consciousness and initiative in practice.This article begins with a major explanation of the paper' basic consideration and actual meaning The first part is an overview of the investigation of duty crimes in PRC.The second part mainly demonstrates the main problems of duty crime investigation.The third part mainly analyzes the new trend of the current duty crime investigation.The fourth part puts forward to the path and countermeasures for the promotion of duty crime investigation in order to promote consensus and synergy on the basis of the analysis above,so as to promote the comprehensive transformation and development of duty crime investigation.
