On The Perfection Of The Special Investigative Measures Of Job-related Crimes In China

The incidence of the crime by taking advantage of duty has seen a boom in recent years, especially in those cases of "one-to-one" bribe and with the feature of covertness and complicatedness. Comparing with other criminal cases, the crime by taking advantage of duty is featured as being difficult to find clues and to collect evidences, tracking from the suspect to the case, and easily involving foreign interferences. Although the amendment of the Criminal Procedure Law issued in2012has established the measures such as technical investigation and secret investigation, there still exist defects and weaknesses at legislation level.In consideration of the specialty of the crime by taking advantage of duty and relevant regulations, it is necessary to add the measure of compulsory evidence collection, improve the technical investigation and exclude the temptation investigation included in the secret investigation in legislation. Meanwhile, the procuratorial organ should been strictly ruled when conducting special investigation behaviors.
