Research On The Benefit Problem In The Use Of Civil Air Defense Engineering

Civil air defense projects built in conjunction with civil buildings are buildings(structures)that are attached to land and bear the public purpose of taking refuge in wartime or in emergency situations.It is a state compulsory development and construction unit that invests in the construction of new civil buildings.The main purpose is to provide shelter for people in the construction area and in certain radiation areas during a war or disaster.In order to achieve efficient use of resources,the country has proposed the principle of “combination of peace and warfare”,that is,to encourage the full play of the economic value of such air defense basements during non-war or during non-emergencies.With the development of the economic value of such air defense buildings,due to the lagging of legislation,there is an increasing number of disputes concerning the interests of related entities that occur during the use of this air defense project.The main content of this paper is the combination of civil defense for the construction of civil buildings.The project's revenue problem.This article comprehensively uses statistical analysis,literature research,normative analysis,comparative analysis,and value analysis.It mainly discusses in the following aspects: The first part mainly analyzes the related concepts of built-up civil air defense projects to clarify the following main researches.The object category provides a theoretical basis for the development of research content.The second part analyzes the status quo of the benefits of construction-based civil air defense projects from two aspects of legislation and judicial practice,and introduces the problems in the use of the project.The third part is the suggestion to improve the benefits of China's built-in civil air defense projects: Firstly,it analyzes the relevant regulations outside the jurisdiction,provides opinions for solving the problem of the benefits of built-up civil air defense projects in China,and secondly,defines the ownership of income rights;Finally,it solves the problem of management,use,and distribution of benefits that exist in practice.
