Research On Legal Problems Of Sharing Bicycle Deposits

Since the birth of a shared bicycle,it has rapidly become a global hot spot.People regard it as an outstanding representative of "China's intellectual creation." As a new star in the "Internet +" era,shared bicycles have received more and more attention.At the same time,the legal issues arising from the use of shared bicycles by users have been successive one after another.Typical problems include the loss of a single-car platform deposit,the unreliability of the user's deposit in dire conditions,the unclear of deposit interest,and the complicated procedures for returning the deposit.These issues are no longer cases and urgently need to be resolved.Based on the idea of “finding the problem—presenting the problem—solving the problem”,this paper divides the full text into three parts.The first part elaborates the concepts and characteristics of shared bicycles and deposits,and analyzes the legal relationships existing in the use of shared bicycle rental.Mainly introduces the specific manifestation of the sharing of bicycle rental guarantee-deposit guarantee,through the comparative analysis with the existing legal provisions of the form of security,to understand the characteristics of the understanding of the deposit,the first part to pave the way for writing,the focus of writing this article is the second and the third part.In the second part,the author points out the problems existing in the reality and summarizes the reasons.There are many problems in the sharing of bicycle deposits.This article mainly analyzes the nature of deposits,the unclear attribution of interests,the imperfection of user rights protection mechanisms,and the incompleteness of the deposit supervision system.The third part is the legal advice on solving the problems in the second part and finding a reasonable solution.The author combines the current situation of domestic legislation and the case cited in judicial practice to analyze in detail the ownership of the deposit and its interest and the ways to find a reasonable use.Based on the legislative provisions that draw on foreign deposits,we propose measures to protect the legitimate rights and interests of the shared bicycle tenant deposit.In addition,in view of the problem of imperfect supervision of shared bicycle deposits,the author combines China's current situation and proposes a regulatory proposal to improve the sharing of bicycledeposits in China.It is hoped that this study will have a positive effect on the management of shared bicycle deposits and will serve as a reference for the resolution of deposit issues.
